How do you know he stole it?

Did you ask Alan Silvestri?

Why couldn't he have subconciously pick up on something he had heard?

"Stole" is too harsh a word when you don't know the situation under which the score was written. I agree wholeheartedly that The Ten Commandments is a great score (and it needs a decent re-issue), and maybe Silvestri has heard it (yet to be determined), and if he has then maybe he was not knowingly using it, or maybe it was used as an homage, or maybe it was a printing error from the copyist who was drinking too much the night before and when Mr. Silvestri heard the music he thought that it was better than what he wrote -- so he had that copyist fired so he could keep it secret... And maybe I'm that copyist...
But I wouldn't know because I'm drunk...
You just don't know.
