NOTICE OF VIOLATION:

I am a consumer advocate who surfs the web on behalf of the Internet Content Rating Association (ICRA) in enforcement of the Children's Internet Protection Act (CIPA), which is a federal law enacted by Congress in December 2000. The law demands that any U.S. site serving obscene content must contain ICRA content labels that will block the site from access in places such as schools and public libraries.

We are reporting Filmtracks.com as a violator at the worst level of indecency. It is a site that promotes itself within the mainstream entertainment industry, containing (but not restricted to) information about movies and music pertaining to children's films. Upon entering Filmtracks.com, however, a visitor is confronted by considerable obscene material and the site IS NOT REGISTERED with an ICRA label to restrict access to minors. We are herein recommending sanctions of Filmtracks.com to the Federal Communications Commission's Enforcement Bureau, Investigations and Hearings Division in Washington, D.C.

The standards by which Congress has given the FCC the responsibility for administratively enforcing are: An average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest; The material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and The material, taken as a whole, must lack serious literary, artistic, political, or scientific value.

Decency Content Violations at Filmtracks.com include, but are not limited to:

Discussions of:

Erections or female genitals in detail
Male genitals
Female genitals
Female breasts
Bare buttocks
Animal genitals
Explicit sexual acts
Obscured or implied sexual acts
Passionate kissing
Blood and gore, human beings
Blood and gore, animals
Blood and gore, fantasy characters (including animation)
Killing of human beings
Killing of animals
Killing of fantasy characters (including animation)
Deliberate injury to human beings
Deliberate injury to animals
Deliberate injury to fantasy characters (including animations)
Deliberate damage to objects
Deliberate destruction of government property
Explicit sexual language
Crude words or profanity
Mild expletives
Promotion of alcohol use
Promotion of drug use
Gambling
Promotion of weapon use
Promotion of discrimination or harm against people

Publishing of:

Material that might be perceived as setting a bad example for young children
Material that might disturb young children
Material that might be perceived as destructive to moral integrity
Material that might be deemed as dangerous to the security of the United States

The above indecency meets FCC guidelines as "language or material that, in context, depicts or describes, in terms patently offensive as measured by contemporary community Internet standards for the public access medium, sexual or excretory organs or activities." Filmtracks.com is especially indecent in areas of language and sexual content.

Filmtracks.com must immediately register for an ICRA rating of "Restricted - Adult" or face possible fines or closure by the FCC. The label is easy to obtain, and is the right and moral action to take.
